Constitutionnalisme idyllique – La Constitution entre la réalité normative et la rêverie interprétative

Résumé

L’article examine le phénomène du constitutionnalisme idyllique — une posture herméneutique dans laquelle le lien affectif entre l’interprète et la Constitution se substitue, de manière dissimulée, à l’obéissance au document réel. En articulant la psychanalyse, la théorie du droit et la jurisprudence, la réflexion décrit comment l’interprète, frustré par les imperfections du texte constitutionnel, recourt à un contrôle de moralité déguisé en interprétation systématique. Du Baron de Montesquieu à Platon et Saint Augustin, en passant par la doctrine de Carlos Ayres Britto, l’étude analyse comment la jurisprudence du Tribunal Suprême Fédéral (STF) — notamment dans le RE 328.232/AM et l’ADPF 132/RJ — a incorporé des éléments de cette lecture romanticisée. La thèse centrale soutient qu’accepter la Constitution telle qu’elle est, avec ses défauts et ses contradictions, constitue une exigence incontournable pour quiconque prend au sérieux l’État démocratique de droit.

Idyllic Constitutionalism – The Constitution Between Normative Reality and Interpretive Reverie

Abstract

The article investigates the phenomenon of idyllic constitutionalism — a hermeneutic posture in which the affective bond between interpreter and Constitution dissimulately replaces obedience to the real document, thereby establishing what has come to be termed idyllic constitutionalism. Drawing together psychoanalysis, legal theory, and case law, the reflection describes how the interpreter, frustrated by imperfections in the constitutional text, resorts to a morality control disguised as systematic interpretation. From Baron de Montesquieu to Plato and Saint Augustine, and passing through the doctrine of Carlos Ayres Britto, the study examines how the case law of the Federal Supreme Court (STF) — particularly in RE 328.232/AM and ADPF 132/RJ — has incorporated elements of this romanticized reading. The central thesis holds that accepting the Constitution as it is, with its flaws and contradictions, constitutes an unavoidable requirement for anyone who takes the Democratic Rule of Law seriously.

Idyllischer Konstitutionalismus – Die Verfassung zwischen normativer Wirklichkeit und interpretatorischer Schwärmerei

Zusammenfassung

Der Beitrag untersucht das Phänomen des idyllischen Konstitutionalismus — eine hermeneutische Haltung, in der die affektive Bindung zwischen Interpret und Verfassung den Gehorsam gegenüber dem realen Dokument verschleiert und durch eine idealisierte Fassung ersetzt. Ausgehend von Baron de Montesquieu und der Idee der Gewaltenteilung verbindet die Reflexion Psychoanalyse, Rechtstheorie und Rechtsprechung, um zu beschreiben, wie der Verfassungsinterpret, frustriert von Unvollkommenheiten des Verfassungstextes, auf eine als systematische Auslegung getarnte Moralitätskontrolle zurückgreift. Unter Rückgriff auf Platon, Augustinus, Carlos Ayres Britto und die Rechtsprechung des Obersten Bundesgerichts (STF) — insbesondere RE 328.232/AM und ADPF 132/RJ — werden doktrinäre Diagnosen, Beispiele aus der brasilianischen Forensikpraxis und konstitutive Episoden der Verfassunggebenden Versammlung von 1988 durchschritten. Der Beitrag vertritt die zentrale These, dass die Verfassung so anzunehmen ist, wie sie ist, mit ihren Mängeln und Widersprüchen, als unabdingbare Anforderung an jeden, der den demokratischen Rechtsstaat ernst nimmt.
