A symbolic reflection on unrestrained power in constitutional democracy

Abstract

This article examines the figure of Homelander from the series The Boys as a critical metaphor for the dynamics of unrestrained institutional power in constitutional democracy. The central thesis holds that the fictional character – a tyrant disguised as a hero who claims to defend democracy while undermining its foundations – serves as an illuminating mirror for certain attitudes observed in the contemporary Supremo Tribunal Federal (STF). The analysis draws upon the concepts of institutional salvationism, constitutional hybris, and moral solipsism to shed light on the dangers of a judiciary without effective checks.

The study introduces the concept of egoic self-restraint – a psychic precondition that precedes juridical self-restraint (judicial self-restraint), designating the adjudicator’s capacity to recognize that he is not the measure of the just. When this inner brake fails, moral solipsism ensues, in which the adjudicator treats his own conscience as the exclusive source of juridicity and the Law degenerates into a monologue disguised as jurisdiction. The essay further analyzes selective consequentialism and rhetorical cynicism as instruments for legitimizing arbitrary decisions.

In conclusion, it is argued that the “Homelander in judicial robes” is not an individual figure but a structural position that may be occupied by any actor who succumbs to the temptation of believing himself indispensable. The work advocates for the restoration of epistemic humility as a constitutional virtue, and emphasizes that mature democracies rest upon structures, not upon personalities deemed providential. Judicial self-restraint and collegiality are reaffirmed as indispensable preconditions of the democratic rule of law.

Zusammenfassung

Der vorliegende Aufsatz untersucht die Figur des Homelander aus der Serie The Boys als kritische Metapher für die Dynamik ungezügelter institutioneller Macht in der konstitutionellen Demokratie. Im Mittelpunkt steht die These, dass der fiktionale Charakter – ein als Held getarnter Tyrann, der Demokratie zu verteidigen vorgibt, während er ihre Grundlagen untergräbt – als erhellender Spiegel für bestimmte Haltungen im zeitgenössischen Supremo Tribunal Federal (STF) dient. Die Analyse stützt sich auf die Begriffe des institutionellen Salvationismus, der konstitutionellen Hybris und des moralischen Solipsismus, um die Gefahren einer Justiz ohne wirksame Kontrollmechanismen zu beleuchten.

Die Studie führt den Begriff der egoischen Selbstbeschränkung ein – eine der juristischen Selbstbeschränkung (judicial self-restraint) vorgelagerte psychische Voraussetzung, die die Fähigkeit des Richters bezeichnet, anzuerkennen, dass er nicht das Maß des Gerechten ist. Wenn diese innere Bremse versagt, entsteht ein moralischer Solipsismus, in dem der Richter sein eigenes Gewissen als ausschließliche Quelle der Rechtlichkeit behandelt und das Recht zu einem als Rechtsprechung getarnten Monolog degeneriert. Der Aufsatz analysiert ferner den selektiven Konsequentialismus und den rhetorischen Zynismus als Instrumente der Legitimierung willkürlicher Entscheidungen.

Abschließend wird argumentiert, dass der „Homelander in der Robe” keine Einzelfigur, sondern eine strukturelle Position darstellt, die von jedem Akteur besetzt werden kann, der der Verführung erliegt, sich für unentbehrlich zu halten. Die Arbeit plädiert für die Wiederherstellung der epistemischen Demut als konstitutionelle Tugend und betont, dass gereifte Demokratien sich auf Strukturen stützen, nicht auf als providenziell geltende Persönlichkeiten. Die richterliche Selbstbeschränkung und die Kollegialität werden als unverzichtbare Voraussetzungen des demokratischen Rechtsstaats bekräftigt.

Fractures of Judicial Activism and Fissures in Constitutional Democracy

Abstract

This article examines judicial activism in the Brazilian Supreme Federal Court (STF) through the metaphorical image of the Procrustean bed. Drawing on Georges Abboud’s classification, it employs mythological figures — Echo, the Oracle of Delphi, Procrustes, Prometheus, Pygmalion, the Bacchants, the Erinyes, Daedalus, Endymion, and Cronos — to illuminate the different modalities of activism that produce fractures in the constitutional order and fissures in the democratic structure.

The central thesis holds that judicial activism must be understood as a process of transition between fissure and fracture: the fissure emerges when the decision begins to drift from the Constitution, statutes, and due process, even under seemingly noble justifications; the fracture occurs when this practice solidifies into a decisional method, compromising the structure of constitutional democracy. Judicial self-restraint, therefore, is not institutional cowardice but rather the mast of Ulysses — the mechanism through which the Court binds itself to law so as not to succumb to seductions external to the Constitution.

The article concludes that the countermajoritarian role of the STF, though indispensable, presupposes rigorous fidelity to the Constitution, statutes, and the procedural framework. Without these bonds, constitutional adjudication ceases to protect the Constitution and begins to replace it with judicial power. The Court may hear the Sirens; it may not follow their music.
