L\u2019\u00e9tude montre que la <strong>Constitution imp\u00e9riale de 1824<\/strong> consacrait cette garantie en termes textuels absolus, tandis que les Constitutions r\u00e9publicaines l\u2019ont r\u00e9duite \u00e0 une simple disposition structurelle.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Il est d\u00e9montr\u00e9 que le terme <strong>\u00ab recours \u00bb<\/strong> dans l\u2019article 5, LV de la Constitution de 1988 d\u00e9signe des <strong>instruments proc\u00e9duraux de r\u00e9action, de contestation et de contr\u00f4le des d\u00e9cisions judiciaires<\/strong>, et que la garantie doit \u00eatre comprise comme une <strong>garantie \u00e9largie du contradictoire<\/strong>. La juste position r\u00e9side dans une <strong>possibilit\u00e9 de recours ad\u00e9quate<\/strong>, qui soumet toute d\u00e9cision judiciaire \u00e0 un m\u00e9canisme de contr\u00f4le sans \u00e9tablir un droit absolu d\u2019appel. Sans cette garantie, le citoyen est r\u00e9duit \u00e0 un <strong>mannequin de paille<\/strong> \u2013 un simple simulacre de protection constitutionnelle.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\"><strong>Mots-cl\u00e9s :<\/strong> Possibilit\u00e9 de recours.
