Abstract<\/h3>\n\n\n\n

This article examines the systematic devaluation of attorney’s fees awarded due to defeat<\/strong> in the Brazilian Judiciary from a psychoanalytic perspective. Although Article 85 of the CPC<\/strong> establishes precise rules \u2014 with express percentages, graduated brackets, and a prohibition of equity<\/strong> in high-value cases \u2014, the STJ<\/strong> has already established 43 binding theses<\/strong> on the subject, a statistical volume that reveals a mismatch between normative clarity and concrete application.<\/p>\n\n\n\n

The analysis draws on the concept of defense by devaluation<\/strong> (devaluation defense<\/em>) from Melanie Klein<\/strong> and on the Lacanian theory of envy<\/strong>, to demonstrate that the discretionary reduction of attorney’s fees is not a mere technical error, but a psychic symptom<\/strong>: the attempt to neutralize the narcissistic pain caused by the existence of the good object \u2014 the lawyer’s remuneration.<\/p>\n\n\n\n

The article analyzes the institutional costs<\/strong> of this symptom \u2014 the impoverishment of legal certainty<\/strong>, the artificial inflation of litigation<\/strong>, and the institutional solitude of the lawyer<\/strong> \u2014 and proposes as a way out the conversion of envy into gratitude<\/strong>, which translates, on the institutional plane, into compliance with the law<\/strong> and the recognition of advocacy<\/strong> as a function coessential to Justice.<\/p>\n\n\n\n
