Self-appointed guardianship constitutes a <strong>preventive existential legal transaction<\/strong> by which a person, while still fully capable, establishes <strong>anticipated directives<\/strong> for the event of future <strong>mental incapacity<\/strong>, designating a guardian, setting preferences regarding <strong>medical treatments<\/strong>, and determining <strong>asset management<\/strong>. The study addresses the technique of <strong>voluntary representation<\/strong> (art. 116, Brazilian Civil Code), <strong>validity requirements<\/strong> (art. 104, Brazilian Civil Code), the <strong>binding effect on the judge<\/strong>, and the recommended form of <strong>public deed<\/strong>.
